By creating an account, accessing restricted areas or using platform features, the user confirms that they have read and understood these Terms and agree to be bound by them, without prejudice to any mandatory rights granted by applicable law.
ÉLAN PRIVÉ is a digital platform operated by the entity identified below. The operator’s definitive identification details must remain permanently accessible to users.

These Terms govern access to, registration with and use of ÉLAN PRIVÉ, including the features made available to Members, Providers and other visitors to the platform.
Certain features, payments or services may be subject to additional conditions presented to the user before the relevant purchase or use.
ÉLAN PRIVÉ provides a digital infrastructure for curation, presentation, discovery and contact between users, including Provider profiles, permitted content and services and requests submitted through the platform’s internal features.
Curation means that ÉLAN PRIVÉ may review, organise, moderate, approve, reject, restrict, suspend or remove profiles and content in accordance with these Terms, applicable law and platform policies. Approval or presentation of a profile does not constitute certification, a professional recommendation or an absolute guarantee regarding the Provider’s identity, quality, safety, availability, legality or suitability.
Unless expressly stated otherwise, ÉLAN PRIVÉ does not provide the services advertised by Providers and does not act as their representative, agent or employer.
Use of ÉLAN PRIVÉ is strictly limited to persons aged 18 or over who have the legal capacity required for the acts and contracts associated with use of the platform.
Minors may not create or use accounts. ÉLAN PRIVÉ may request reasonable verification measures where there are justified doubts concerning a user’s eligibility.
Users must provide truthful, current and appropriate information during registration and keep relevant account information up to date.
Login credentials are personal and must not be shared. Users are responsible for taking reasonable steps to preserve their confidentiality and must notify the platform of suspected unauthorised access.
Users may not create accounts under a false identity, use third-party information without authorisation, circumvent suspensions or use the platform for fraudulent or unlawful purposes.
A Member account provides access to features made available to Members, including discovery of profiles and services and use of internal request or contact mechanisms. Those features must be used in accordance with these Terms, applicable law and the rights of other users.
Providers are responsible for the information, images, descriptions, services and other content they submit and represent that they hold all rights, permissions and authority required for its use and publication.
Providers are responsible for ensuring that their activity, presentation, content and any services comply with the laws applicable in the territory where they are offered or performed, including any applicable tax, professional, administrative, employment or other legal obligations.
Creating a Provider account or paying a subscription does not create an automatic right to approval or publication of any profile or content.
Users may only publish lawful content that is truthful regarding relevant factual matters and compatible with the purpose and rules of the platform.
Users retain any rights they legally hold in submitted content and grant ÉLAN PRIVÉ, to the extent required to operate the platform, a non-exclusive permission to host, technically reproduce, format, display and make that content available through the service while it remains published.
The platform may not be used to publish, request, promote, facilitate or transmit content or activities that are unlawful, infringe third-party rights or endanger users.
Prohibited material includes, without limitation, content involving exploitation or abuse of minors, human trafficking or exploitation, violence or threats, coercion, fraud, impersonation, unlawful discrimination, non-consensual disclosure of intimate material or personal data, infringement of intellectual property rights, non-consensual activities or any other unlawful content or conduct.
ÉLAN PRIVÉ may moderate profiles, services and content submitted by users in order to assess compliance with these Terms, platform policies and applicable law.
Moderation measures may include reduced visibility, rejection, removal or blocking of content, restriction of features and suspension or termination of accounts. Where applicable, decisions will be taken diligently, objectively and proportionately, taking into account the nature and seriousness of the matter and the legitimate rights and interests of affected parties.
Moderation is predominantly carried out through human review and technical security and platform-management mechanisms. If automated systems are later used for material moderation decisions, the applicable information will be updated transparently.
Any person may report content or conduct that they believe to be unlawful, dangerous or incompatible with these Terms. Reports should identify the relevant content or situation with sufficient precision and, where possible, explain the reasons for the report.
Reports will be reviewed diligently and without arbitrary treatment. ÉLAN PRIVÉ may request additional information where required to assess the matter properly and will take appropriate action where sufficient grounds exist.
The platform provides technological mechanisms enabling Members and Providers to discover and contact one another. Each user independently decides whether to begin, continue or end any interaction.
Unless expressly stated otherwise, any agreement concerning services presented by a Provider is entered into directly between the relevant parties, who are responsible for establishing and complying with their terms within the limits of applicable law.
ÉLAN PRIVÉ does not guarantee that contact will result in a transaction, that a Provider will accept a particular request or that a Member will continue an interaction initiated through the platform.
Access to commercial features intended for Providers may require a paid subscription. The price, billing frequency, applicable taxes and relevant commercial conditions are displayed before payment is confirmed.
Where displayed on the platform at €16.90 per month, the Provider subscription grants access to the features included in the relevant plan while the subscription remains active, without guaranteeing content approval, ranking, minimum visibility, requests, customers or any financial result.
The commercial conditions presented at the time of purchase prevail regarding price, taxes, billing frequency and the specific features included.
Platform subscription payments may be processed through external payment service providers. ÉLAN PRIVÉ does not store complete card details where those details are entered directly into the payment provider’s infrastructure.
Users are responsible for providing valid payment information and reviewing the total price and other conditions displayed during checkout before completing a purchase.
Where a subscription is presented as recurring, it may renew automatically according to the billing frequency and conditions clearly displayed before purchase. Providers may request or perform cancellation through the mechanisms available in their account or through Support.
Unless applicable law or the conditions presented at purchase provide otherwise, cancellation prevents future renewals and does not retroactively cancel a subscription period that has already begun and was validly purchased.
Where the user legally qualifies as a consumer and a right of withdrawal applies to a distance contract, that right may be exercised within the applicable statutory period, generally 14 days from conclusion of a service contract, subject to the exceptions and conditions established by applicable law.
Where the user requests that performance begin during the withdrawal period, the statutory rules concerning early performance, any amounts payable and circumstances in which the right may cease will apply.
ÉLAN PRIVÉ may restrict features, suspend or terminate accounts where justified by breach of these Terms, payment default, security risks, fraud, abuse, unlawful content, legal requirements or the protection of third parties and the platform.
Where legally and reasonably possible, measures will take account of the seriousness, frequency and consequences of the matter. Moderation or restriction decisions may be reconsidered where the user submits relevant information through the channels provided by the platform.
The ÉLAN PRIVÉ brand, visual identity, design, software, structure, proprietary text, graphic elements and other platform-owned content are protected by applicable law and may not be reproduced, exploited or used outside authorised uses.
User-submitted content remains subject to the rights of its respective owners. Users may not publish third-party material unless they hold the necessary rights or permissions.
Processing of personal data associated with the use of ÉLAN PRIVÉ is described in the Privacy Policy. These Terms do not replace that information.
Users may not attempt to gain unauthorised access to accounts, systems, servers or databases, interfere with platform operation, introduce malicious code, perform unauthorised automated data collection or circumvent security mechanisms.
Technical security measures cannot eliminate every risk associated with online services. Users should take appropriate security precautions and exercise reasonable care in their interactions.
ÉLAN PRIVÉ seeks to maintain reasonable platform availability and security but does not guarantee uninterrupted or error-free operation. Maintenance, updates, technical changes, third-party failures or circumstances beyond the operator’s reasonable control may cause interruptions.
Each user is responsible for their own conduct, the content they publish and decisions made following contacts established through the platform.
To the extent permitted by applicable law, ÉLAN PRIVÉ is not responsible for the performance of obligations entered into directly between Members and Providers or for statements, acts or omissions attributable exclusively to those users.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law or affects mandatory consumer rights.
These Terms may be updated to reflect legal, regulatory, technical, commercial or functional changes to the platform. Material changes will be communicated to users through appropriate means and the applicable version will remain available on this page.
Users may stop using the platform and request closure of their account, without prejudice to obligations, payments, third-party rights or legal duties that must survive closure. Certain information may be retained for periods required or permitted by law, as described in the Privacy Policy.
These Terms are governed by Portuguese law and directly applicable European Union law, without prejudice to mandatory protections that may apply to users according to their legal status and place of residence.
Any provision concerning court jurisdiction must be interpreted without prejudice to mandatory consumer rights, including access to courts or alternative dispute resolution mechanisms where legally applicable.
Questions concerning these Terms, use of the platform, content or moderation decisions may be submitted through ÉLAN PRIVÉ Support or the official electronic address identified in the operator information.
